1. Agreement to Terms

These Terms of Use constitute a legally binding agreement between you and Habitly, part of the JetStrive ecosystem, concerning your access to and use of our services.

By using Habitly, you agree to be bound by these Terms and our Privacy Policy. If you disagree, you do not have permission to use the Services.

2. Eligibility

To use our Services, you must:

• Be at least 13 years of age
• Have legal capacity to enter into these Terms
• Not be prohibited from using the Services under applicable laws
• Not have been previously banned from the Services

3. Account Registration and Security

You must provide accurate information during registration. You are responsible for:

• Maintaining confidentiality of your credentials
• All activities under your account
• Notifying us of unauthorized account use

You may not share credentials, create multiple accounts, or allow others to use your account.

4. Use of Services

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes.

You agree not to:

• Use the Services for illegal purposes
• Infringe upon intellectual property rights
• Transmit viruses or malware
• Gain unauthorized access to our systems
• Interfere with or disrupt the Services
• Use automated tools (bots, scrapers)
• Reverse engineer any part of the Services
• Spam, harass, or harm others

5. Subscriptions and Payments

5.1 Free and Premium Services

Habitly offers free accounts (limited to 5 habits) and premium subscriptions with unlimited habits and advanced features.

5.2 Subscription Fees and Renewal

Premium subscriptions are billed monthly or annually at disclosed rates. All fees are non-refundable except as required by law. Subscriptions automatically renew unless canceled before the renewal date.

5.3 Payment Processing

Payments are processed through third-party processors (RevenueCat, Apple/Google Pay). You authorize us to charge your payment method for all fees incurred.

5.4 Cancellation and Refunds

Cancel anytime through account settings or your subscription platform. Refunds are generally not provided except as required by law. Contact [email protected] for refund requests.

6. User Content

You retain ownership of all content you create (habits, notes, mood entries). By submitting content, you grant us a license to use, store, and process it to provide and improve the Services.

You are responsible for your content and warrant that it doesn't violate laws or third-party rights. We may remove content that violates these Terms.

7. Intellectual Property Rights

The Services, including all content, features, software, designs, and trademarks (excluding User Content), are owned by Habitly and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part without our permission.

8. Third-Party Services

The Services may contain links to third-party websites or services. We are not responsible for their content or practices. Your use of third-party services is at your own risk and subject to their terms.

9. Disclaimers and Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We do not warrant that the Services will be uninterrupted, secure, error-free, or meet your requirements.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HABITLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.

Our total liability shall not exceed the amount you paid in the twelve months preceding the claim, or $100 USD, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless Habitly from claims, liabilities, damages, and expenses arising from your use of the Services, violation of these Terms, your User Content, or violation of third-party rights.

12. Termination

You may terminate your account anytime using the account deletion feature. We may suspend or terminate your access for violations of these Terms, fraudulent activity, or technical reasons.

Upon termination, your right to use the Services ceases. Provisions that should survive termination (ownership, disclaimers, liability limitations) shall remain in effect.

13. Dispute Resolution

If you have a dispute, first contact [email protected] and attempt informal resolution for at least 30 days. If unresolved, disputes shall be resolved through binding arbitration.

CLASS ACTION WAIVER: Claims may only be brought individually, not as part of class or representative proceedings.

14. Governing Law

These Terms shall be governed by applicable laws without regard to conflict of law provisions. Actions not subject to arbitration shall be in courts of appropriate jurisdiction.

15. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement. If any provision is invalid, remaining provisions remain in effect. We may update these Terms at any time; continued use constitutes acceptance.
